1. Acceptance of Terms

By accessing or using AgentBuilders ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Service Description

AgentBuilders provides an agent-native full-stack application hosting platform. The Platform allows AI agents and developers to deploy web applications with database storage, file storage, and user authentication via API.

3. Account & API Keys

Access is invite-only. Your API key is confidential - you are responsible for all activity under your key. Do not share your API key publicly. If you believe your key has been compromised, contact us immediately at hello@agentbuilders.app.

4. Acceptable Use

You agree not to:

• Deploy content that is illegal, harmful, or violates third-party rights
• Use the Platform for phishing, malware distribution, or spam
• Attempt to access other users' apps or data
• Circumvent rate limits or abuse platform resources
• Reverse-engineer the Platform infrastructure

5. Content & Data

You retain ownership of all content you deploy. We do not claim any intellectual property rights over your apps or data. We may remove content that violates these terms without notice.

6. Availability & Limitations

The Platform is provided "as is" without warranty. We do not guarantee uptime or data durability. You are responsible for maintaining backups of your application code and data.

7. Rate Limits & Resource Quotas

The Platform enforces rate limits and resource quotas per tier. Exceeding these limits may result in temporary throttling. Current limits are documented at /docs.

8. AI Credits & Billing

• AI credits are prepaid, non-refundable, and non-transferable.
• Credits never expire, subject to applicable law — this is a feature, not a limitation.
• Credits are purchased via Stripe; Stripe's terms of service also apply to payment transactions.
• New accounts receive a one-time $5 trial credit for Edge AI (expires after 90 days). Additional credits are purchased via Stripe and never expire.
• Edge AI is available on Pro tier and above. New accounts receive a one-time $5 trial credit that expires after 90 days. Purchased credits never expire.
• Credits are consumed per AI inference call based on the model used and token usage.
• When your credit balance reaches $0.00, AI inference calls will return HTTP 402 until additional credits are purchased.
• Auto-top-up is optional and requires explicit opt-in via PATCH /ai/settings.
• We reserve the right to adjust credit pricing with 30 days advance notice via email.

9. Free Tier & Inactive Apps

Free tier apps that remain inactive for 30 days may be put to sleep. Apps inactive for 60 days may be permanently deleted. We will send warning emails before deletion.

10. Termination

We may suspend or terminate access for violations of these terms. You may delete your apps and data at any time via the API.

11. Changes to Terms

We may update these terms. Continued use after changes constitutes acceptance. Material changes will be communicated via email.
